Common questions

Questions injured people ask us

Do I even have a case?

If you were hurt because of someone else’s carelessness, talk with an attorney about your options. Insurance companies often delay, deny or blame someone else, so it helps to get advice early.

How long do I have to file a claim?

For injuries on or after July 1, 2024, Louisiana generally allows two years to file a personal injury lawsuit (La. C.C. art. 3493.1). Injuries before that date fall under the former one-year period. Talk to a lawyer soon after an injury so your rights are protected.

TODO: attorney to verify whether to mention that some cases have shorter or longer deadlines.

Will I have to go to trial?

Most personal injury cases settle before trial. Sometimes a case does go to trial, for example when the other side makes no offer or an unreasonable one, or disputes fault or damages.

Should I accept the insurance company’s settlement?

An insurance company is a business, and its goal is to pay as little as possible. Before you sign anything, talk with an attorney about what your claim may involve.
